The use of services from Connexins constitutes agreement to these terms. You may view our Privacy Policy.
Account Setup
After we receive your payment for a product or service, we will promptly setup your account, product, and/or service. For our protection and that of our other clients, each transaction is screened for potential fraud. Please make sure to provide to us valid contact information (at least an email address you already use and check regularly) so we may contact you if any issues arise that would require your attention. Current contact information is also critical for notification of domain name expiration. Connexins is not responsible for a lapsed domain name registration due to outdated contact information associated with your domain. If you need to verify or change this information, please contact us. Providing false contact information of any kind may result in the termination of your account.
Transfers
Connexins transfer team will make every effort to help you transfer your existing domain and website files to our servers. However, transfers are provided as courtesy. We cannot make guarantees regarding the availability, possibility, or time required to complete an account transfer. We will conduct most transfers free of charge. However, if your transfer will require additional time and/or resources, we may require an additional fee.
Your Website Content
All services provided by Connexins may only be used for lawful purposes, as deemed by the law of the United States of America. The customer agrees to indemnify and hold harmless Connexins from any claims resulting from the use of our services.
Use of our services to infringe upon any copyright or trademark laws is prohibited. This includes, but is not limited to, unauthorized copying of music, books, or photographs. Selling counterfeit merchandise of a trademark holder will result in the immediate termination of your account. Any account found to be in violation of copyright will be removed. If an account is found to be in repeated copyright laws violation will be suspended and/or terminated. If you believe that your copyright or trademark is being infringed upon by a Connexins client, please email abuse@connexins.com.
Using a Connexins Hosting Plan as a backup/storage device is not permitted, with the exception of one cPanel backup of the same account.

- Proxy Scripts/Anonymizers
- Pirated Software/Warez
- Image Hosting Scripts (similar to Photobucket or Tinypic)
- AutoSurf/PTC/PTS/PPC sites
- IP Scanners
- Bruteforce Programs/Scripts/Applications
- Mail Bombers/Spam Scripts
- Banner-Ad services (commercial banner ad rotation)
- File Dump/Mirror Scripts (similar to rapidshare)
- Commercial Audio Streaming (more than one or two streams)
- Escrow/Bank Debentures
- High-Yield Interest Programs (HYIP) or Related Sites
- Investment Sites (FOREX, E-Gold Exchange, Second Life/Linden Exchange, Ponzi, MLM/Pyramid Scheme)
- Sale of any controlled substance without prior proof of appropriate permit(s)
- Prime Banks Programs
- Lottery Sites
- MUDs/RPGs/PBBGs
- Hateful/Racist/Harassment oriented sites
- Hacker focused sites/archives/programs
- Sites promoting illegal activities
- Forums and/or websites that distribute or link to warez/pirated/illegal content
- Bank Debentures/Bank Debenture Trading Programs
- Fraudulent Sites (Including, but not limited to sites listed at aa419.org & escrow-fraud.com)

Connexins services and networks are provided for authorized use only. We may monitor our systems to ensure lawful and authorized use. Any account found connecting to a third party network or system without permission from the third party is subject to suspension. Access to networks or systems outside of your direct control must be with expressed written consent from the third party. We may, at our discretion, request and require documentation to prove that your access was authorized.
We reserve the right to refuse service to anyone. Any material that, in our judgment, is inappropriate, threatening, illegal, or violates our terms of service in any manner may be removed from our servers (or otherwise disabled), with or without notice. Failure to respond to email from our Abuse department within 48 hours may result in the suspension or termination of your services. If in doubt regarding the acceptability of your site or service, please contact us at abuse@connexins.com and we will be happy to assist you.
Potential harm to anyone, particularly minors is strictly forbidden, including but not limited to child pornography or content perceived to be child pornography: Any site found to host child pornography or linking to child pornography will be suspended immediately without notice. Violations will be reported to the appropriate law enforcement agency.
Internet Abuse
You may not engage in illegal, abusive, or irresponsible behavior, including:
a) Unauthorized access to or use of data, systems or networks, including any attempt to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without express authorization of the owner of the system or network;
b) monitoring data or traffic on any network or system without the authorization of the owner of the system or network;
c) Interference with service to any user, host or network including, without limitation, mail bombing, flooding, deliberate attempts to overload a system and broadcast attacks;
d) Use of an Internet account or computer without the owner’s authorization, including, but not limited to Internet scanning (tricking other people into releasing their passwords), password robbery, security hole scanning, and port scanning;
e) Forging of any TCP-IP packet header or any part of the header information in an e-mail or a newsgroup posting; or
f) Any conduct that is likely to result in retaliation against the Connexins network.
g) Use of Connexins network resources in a way that unreasonably interferes with other customers use of the network
Newsgroup, Chat Forums, Other Networks
You must comply with the rules and conventions for postings to any bulletin board, chat group or other forum in which you participate, such as IRC and USENET groups including their rules for content and commercial postings. These groups usually prohibit the posting of off-topic commercial messages, or mass postings to multiple forums.
It is your responsibility to ensure that scripts/programs installed under your account are secure and permissions of directories are set properly, regardless of installation method. When at all possible, set permissions on most directories to 755 or as restrictive as possible. Users are ultimately responsible for all actions taken under their account. This includes the compromise of credentials such as user name and password. It is required that you use a secure password. If a weak password is used, your account may be suspended until you agree to use a more secure password. Audits may be done to prevent weak passwords from being used. If an audit reveals your password is weak, we will notify you and allow time for you to change/update your password.
Disclaimer: Connexins is under no duty, and does not undertake a duty to monitor or police our customers’ activities and disclaims any responsibility for any misuse of our Hosting network.
Zero Tolerance Spam Policy
We have zero tolerance toward sending unsolicited e-mail, bulk emailing, and spam. “Safe lists” and purchased lists will be considered spam. Any user who sends out spam will have their account terminated with or without notice.
Sites advertised via SPAM (Spamvertised) may not be hosted on our servers. This provision includes, but is not limited to SPAM sent via fax, email, instant messaging, or usenet/newsgroups. No organization or entity listed in the ROKSO may be hosted on our servers. Any account which results in our IP space being blacklisted will be immediately suspended and/or terminated.
Commercial email is allowed only if you utilize a remotely-hosted email service, such as Aweber or Constant Contact, that enforce at the very minimum the policies listed below. Please adhere to their rules, which include, but not limited to:
- Your intended recipients have given their consent to receive e-mail via some affirmative means, such as an opt-in process;
- Your procedures for soliciting consent include reasonable means to ensure that the person giving consent is the owner of the e-mail address for which the consent is given;
- You otherwise comply with the CAN SPAM Act and other applicable law.
These policies apply to email sent from any network by you or any person on your behalf that directly or indirectly refers the recipient to a site hosted via Connexins Hosting service. In addition, you may not use a third party e-mail service that does not enforce similar rules for all its customers. You may not send any unsolicited e-mail, either in bulk or individually, to any person who has indicated that they do not wish to receive it. You must comply with the rules of any other network you access or participate in using your Connexins Hosting services.
Connexins reserves the right to charge the holder of the account used to send any unsolicited e-mail a clean up fee or any charges incurred for blacklist removal. This cost of the clean up fee is entirely at our discretion.
Connexins reserves the right to require changes or disable as necessary any web site, account, database, or other component that does not comply with its established policies, or to make any such modifications in an emergency at its sole discretion.
Payment Information
You agree to supply appropriate payment for the services received from Connexins, in advance of the time period during which such services are provided. You agree that until and unless you notify us of your desire to cancel any or all services received, those services will be billed on a recurring basis.
Cancellations must be done in writing to support@connexins.com. Once we receive your cancellation ticket and have confirmed all necessary information with you via e-mail, we will inform you by email that your account has been canceled. Your cancellation confirmation will contain a ticket/tracking number in the subject for your reference, and for verification purposes. You should immediately receive an automatic “Your request has been received…” email with a tracking number. We will process your cancellation request shortly thereafter. If you do not hear back from us, or do not receive the automatic confirmation email within a few minutes after submitting your cancellation, please let us know via contact us immediately.
As a client of Connexins, it is your responsibility to ensure that your payment information is up-to-date, and that all invoices are paid on time.
You agree that until and unless you notify Connexins of your desire to cancel any or all services received, those services will be billed on a recurring basis, unless otherwise stated in writing. We reserve the right to bill your credit card or billing information on file with us. Connexins provides a 7-day grace period from the time the invoice is generated and when it must be paid. Any invoice that is outstanding for 7-days and not paid will result in a $10 late fee and/or an account suspension until account balance has been paid in full. The $10 late fee is applied in addition to whatever else is owed to us for services rendered. Access to the account will not be restored until payment has been received.
It is the customer’s responsibility to notify us at support@connexins.com after paying for a domain renewal and to ensure the email is received and acted upon. Domain renewal notices and invoices are provided as a courtesy reminder and Connexins cannot be held responsible for failure to renew a domain or failure to notify a customer about a domain’s renewal.
Connexins reserves the right to change the monthly payment amount and any other charges at any time.
Backups and Data Loss
We are not responsible for files and/or data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on our servers. We recommend that you backup your cPanel (which would contain databases, website files, and email folders) on a regular basis. If you do not know how to backup your cPanel, please email us at support@connexins.com. Connexins may be able to restore your cPanel for additional fees. Backups may not be provided for accounts that have been suspended or terminated for any reason unless otherwise agreed to in writing.
Cancellations and Refunds
Connexins reserves the right to cancel, suspend, or otherwise restrict access to the account at any time with or without notice.
Customers may cancel at any time by emailing us at support@connexins.com. We will verify your cancellation request prior to terminating the account. Refunds are only permitted if you are within the first 30 days of service. Violations of the Terms of Service will waive the refund policy.
Resource Usage
User may not:
a) Use 25% or more of system resources for longer then 90 seconds. There are numerous activities that could cause such problems; these include: CGI scripts, FTP, PHP, HTTP, etc.
b) Run stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons, such as IRCD.
c) Run any type of web spider or indexer (including Google Cash / AdSpy) on shared servers.
d) Run any software that interfaces with an IRC (Internet Relay Chat) network.
e) Run any bit torrent application, tracker, or client. You may link to legal torrents off-site, but may not host or
store them on our shared servers.
f) Participate in any file-sharing/peer-to-peer activities
g) Run any gaming servers such as counter-strike, half-life, battlefield1942, etc
h) Run cron entries with intervals of less than 15 minutes.
i) When using PHP include functions for including a local file, include the local file rather than the URL. Instead of include(“http://yourdomain.com/include.php”) use
include(“include.php”)
INODES
The use of more than 250,000 inodes on any shared account may potentially result in a warning first, and if no action is taken future suspension. Accounts found to be exceeding the 100,000 inode limit will automatically be removed from our backup system to avoid over-usage. Every file (a webpage, image file, email, etc) on your account uses up 1 inode.
Sites that slightly exceed our inode limits are unlikely to be suspended; however, accounts that constantly create and delete large numbers of files on a regular basis, have hundreds of thousands of files, or cause file system damage may be flagged for review and/or suspension. The primary cause of excessive inodes seems to be due to users leaving their catchall address enabled, but never checking their primary account mailbox. Over time, tens of thousands of messages (or more) build up, eventually pushing the account past our inode limit. To disable your default mailbox, login to cPanel and choose “Mail”, then “Default Address”, “Set Default Address”, and then type in: :fail: No such user here.
Bandwidth Usage
You are allocated a monthly bandwidth allowance. This allowance varies depending on your hosting package you purchase. In most cases, Connexins Hosting offers 50 GB of bandwidth. Should your account pass the allocated amount, we reserve the right to suspend the account until the start of the next allocation, suspend the account until more bandwidth is purchased at an additional fee, suspend the account until you upgrade to a higher level of package, terminate the account and/or charge you an additional fee for the overages. Unused transfer in one month cannot be carried over to the next month.
Money back Guarantee
Your hosting account features a 30-day unconditional money back guarantee. If you are not completely satisfied with our services within the first 30 days of your service, you will be given a full refund of the contract amount.
Uptime Guarantee
We guarantee 99.9% uptime, otherwise you may receive up to one month of credit on your account. Approval of the credit is at the discretion of Connexins dependent upon justification that you provide to us. Third party monitoring service reports may not be used for justification due to a variety of factors including the monitor’s network capacity/transit availability. The uptime of the server is defined as the reported uptime from the operating system and the Apache Web Server which may differ from the uptime reported by other individual services. To request a credit, please contact support@connexins.com with justification. All requests must be made in writing via email.
Indemnification
Customer agrees that it shall defend, indemnify, save and hold Connexins harmless from any and all demands, liabilities, losses, costs, and claims, including reasonable attorney’s fees asserted against us, our agents, customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless Connexins against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with Connexins; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customers from our server.
Arbitration
Any disputes in excess of $1,000 (or the maximum limit for small claims court) arising shall be submitted to binding arbitration before the Joint Ethics Committee or a mutually agreed upon Arbitrator pursuant to the rules of the American Arbitration Association. The Arbitrator’s award shall be final, and judgment may be entered in any court having jurisdiction thereof. The Client shall pay all arbitration and court costs, reasonable attorney’s fees, and legal interest on any award or judgment in favor of CONNEXINS.
Disclaimer
Connexins shall not be responsible for any damages your business may suffer. Connexins makes no warranties of any kind, expressed or implied for services we provide. Connexins disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, no deliveries, wrong delivery, and any and all service interruptions caused by Connexins and its employees.
Disclosure to law enforcement
While we respect our clients’ privacy, Connexins may disclose any subscriber information to law enforcement agencies without further consent or notification to the subscriber upon lawful request from such agencies. We will cooperate fully with law enforcement agencies.
Changes to the TOS
Connexins reserves the right to revise its policies at any time without notice.
Account Termination If you violate any of the rules listed in this Terms of Service agreement, Connexins reserves the right to terminate your account. In addition, any abuse of our staff in any medium or format will result in the suspension or termination of your services.
